The law concerning sickness and ill health applies to all businesses whatever their size, however it is complex.
If you have been off work for some time due to sickness or ill health and are facing dismissal or have been dismissed, then you may be able to make a claim against your employer. You should have been given a reasonable opportunity to recover and consulted throughout, and a medical report should generally have been obtained before any dismissal. If you have a disability that makes it difficult for you to do your job, you may be entitled to greater protection from being dismissed or poorly treated.
